Two teens charged in Draper Airbnb shooting

DRAPER, Utah— Two individuals were identified and charged in the house party shooting that killed 27-year-old Austin Terry Powell, and 21-year-old Jonathan July Fuentes on April 3, 2022 according to court documents.

Ashtyn Ortega, 18, was charged with two counts of murder, three counts of purchase, transfer, possession, or use of a firearm by restricted person, and one count of a controlled substance with intent to distribute.

Daniel Martinez, 18, was charged with two counts of aggravated murder.

The house party, held at a local Airbnb at a residence in Draper, ended with shots fired around 1 a.m. Police said that when those shots rang out, many fled as fast as they could, speeding away in their cars.

Court documents reveal the manager of the Airbnb showed up to the residence just before the shooting occurred to shut down the party going on, asking everyone to leave. The manager provided video footage from a Ring doorbell camera that “captured approximately 10 loud bangs which appeared to be gunshots.”

Another witness recorded the incident on his phone and provided the footage to detectives which shows the “shooter skipped or jumped around as he fired off rounds toward the direction where the Tesla was parked.”

According to court documents, multiple 9mm bullet casings, 9mm full metal jacket bullets, and an empty tan-colored 9mm Glock magazine were collected on scene.

A “Confidential Source” listed in the court documents described the events of the evening and identified Martinez as the shooter.

The source explained they had been at the party when they were asked to leave by the manager and people began throwing beer bottles into the street.

The source said a “verbal argument began between Martinez and the Tesla driver, Austin Powell.”  In the next moments, the source described how he saw “Ortega pull a gun out of his waistband and give it to Martinez who then shot the Tesla driver and then fled the scene.”

As Martinez shot wildly, police believe shots intended for Powell hit Fuentes as he was leaving the party.

When police arrived on the scene, ” Austin Powell deceased, lying near a 2020 Tesla with bullet holes in the windshield and other parts of the vehicle. A second gunshot victim, later identified as Jonathan Fuentes, was transported to Intermountain Medical Center at 5121 S Cottonwood St. Murray, UT with a gunshot wound to the head. Jonathan was pronounced brain dead and died later that day.”

The neighborhood was locked down for a time, but police did not find the gunman and it was unclear who was involved until now.

In interviews with police, Ortega admitted to handing Martinez  the Glock 19x, sand color. “Ortega identified
Martinez as the one who fired the shots.”

Evidence seized from Ortega’s residence included a tan Glock magazine, marijuana edibles, raw marijuana, an AR15 pistol, a Sig Sauer P365, paraphernalia, and .223- and 9mm ammunition.

In Martinez’s interview with police he told them initially, “that he did not know what the commotion was about and had no idea what caused the shooting. Later in the interview, Martinez admitted that Ortega may have been carrying a gun, but Martinez did not know who was shooting. A few minutes later, Martinez indicated Ortega was the shooter.”

Court documents state, “Martinez was aware that Ortega brought a gun to a party where minors were drinking. When a verbal confrontation occurred MARTINEZ requested the gun from Ortega,
who pulled it from his waistband and provided it to Martinez. Martinez immediately skipped or danced down the street while shooting at the other party in that argument over the beer bottles being broken in the street, killing that person along with an uninvolved person who was walking away from the party.”

Neighbors told KSL TV the home has only been on Airbnb for a few weeks.

The owner has now taken the listing down after what happened and told neighbors the home won’t be up for short-term rental again.

Airbnb shared the following statement on the incident.

“We join the Draper community in condemning this senseless gun violence. We ban parties, and we have removed the booking guest from our platform as we conduct a thorough investigation. We have also reached out to the leadership of the Draper Police Department to offer our assistance as they work to find the person responsible for this criminal act.”
